1. Introduction

Welcome to Ascension Living ("we," "us," or "our"). These Terms and Conditions govern your use of our coaching programs and services. Ascension Living offers neuro-performance coaching programs that incorporate hypnotherapy as a core modality, alongside Psychological Health and Safety advisory services. By booking a session, call, or program with us, you agree to these terms. Please read them carefully.

2. Services

Our coaching programs use hypnotherapy and subconscious-level techniques as a primary modality to support pattern change, performance, and personal recalibration. These services are coaching and personal development in nature. They are not a substitute for professional medical advice, diagnosis, psychological treatment, or therapy. If you have a diagnosed medical or mental health condition, please consult a qualified healthcare professional before beginning a program, and continue any existing treatment alongside our services unless otherwise advised by your healthcare provider.

3. Booking and Payment

Booking. Sessions, calls, and programs can be booked through our website or by contacting us directly. All bookings are subject to availability.

Payment. Payment terms (full payment or payment plan) are confirmed at the time of booking and detailed in your program agreement. We accept payment methods as detailed on our website.

No Refunds. All payments are final. No refunds will be issued once a session, call, or program has been booked and paid for, regardless of attendance, participation, or progress. This applies to single sessions, full program payments, and payment plan instalments. Where a payment plan is in place, all scheduled instalments remain due in full according to the agreed schedule, regardless of cancellation or non-attendance.

Membership and Recurring Payments. Recurring monthly offerings must be cancelled at least 14 days before the next scheduled payment to avoid being charged for the following cycle. Payments already processed are non-refundable.

Rescheduling. Requests to reschedule a session must be made at least 24 hours in advance. Rescheduling is offered at our discretion and is not guaranteed.

4. Confidentiality and Data Protection

We are committed to protecting your personal information and maintaining the confidentiality of your sessions. Information shared during sessions is treated as private and will not be disclosed to third parties except:

Where required by law;

Where we believe in good faith that disclosure is necessary to prevent serious harm to you or another person;

Where you have given express consent for disclosure (for example, to a referring practitioner).

Our collection, use, and storage of your personal data is governed by our [Privacy Policy], which forms part of these Terms. By booking with us, you also acknowledge the marketing and communications preferences you select at the point of booking, in line with applicable consent requirements in your jurisdiction (including GDPR, UK GDPR, CASL, and the Australian Spam Act, where applicable).

5. Client Responsibilities

Health Disclosure. You must inform us of any medical conditions, mental health diagnoses, seizure disorders, or medications that could affect your participation in hypnotherapy or coaching sessions, prior to your first session.

Eligibility. Our services are intended for adults aged 18 and over. By booking, you confirm that you meet this requirement.

Participation. Active participation, honesty, and follow-through on agreed actions between sessions are required for the program to be effective. Outcomes depend significantly on your engagement outside of sessions, which is outside our control.

6. Disclaimers

Results. Outcomes from coaching and hypnotherapy vary by individual. We do not guarantee specific results, timelines, or outcomes from any session or program.

Not Medical or Psychological Treatment. Our services do not constitute medical, psychiatric, psychological, or other licensed clinical treatment, advice, or diagnosis. Nothing said in a session should be treated as a replacement for advice from a licensed medical or mental health professional.

Crisis Situations. Our services are not designed for, and are not appropriate for, crisis intervention. If you are experiencing a mental health crisis or are in danger of harming yourself or others, please contact emergency services or a crisis line in your region immediately.

7. Intellectual Property

All program materials, frameworks, scripts, recordings, written content, and proprietary methodology provided as part of our services (including any "Vault" or program-specific resources) remain the intellectual property of Ascension Living. These materials are licensed to you for personal use only and may not be copied, distributed, resold, or used to deliver services to others without our express written permission.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Ascension Living is not liable for any direct, indirect, incidental, or consequential damages arising from your use of, or inability to use, our services. This includes, without limitation, damages for loss of profits, data, goodwill, or other intangible losses, except where such liability cannot be excluded or limited under applicable law (including consumer protection law in your jurisdiction).

9. Governing Law

These Terms and Conditions are governed by the laws of the Province of Prince Edward Island and the federal laws of Canada applicable therein. Where you are located outside Canada, applicable local consumer protection and data protection laws (including but not limited to GDPR for clients in the EU/EEA, UK GDPR for clients in the UK, and the Australian Consumer Law for clients in Australia) will apply in addition to, and where mandatory, in place of, these governing law provisions, to the extent required by that local law. Any dispute not subject to mandatory local consumer protection law will be resolved in the courts of Prince Edward Island, Canada.

10. Amendments

We reserve the right to amend these Terms and Conditions at any time. Updated terms will be posted on our website with a revised effective date. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
