PRIVACY POLICY

Effective Date: June 2025

Ascension Living ("we," "us," or "our") respects your privacy and is committed to protecting your personal data. This Privacy Policy explains how we collect, use, share, and protect your information when you visit our website [insert website URL], book a session or call, download our resources, or otherwise interact with us. By using our website or services, you agree to the terms of this policy.

We are based in Prince Edward Island, Canada, and serve clients internationally. Where applicable, we comply with the General Data Protection Regulation (GDPR) for clients in the EU/EEA, UK GDPR for clients in the UK, Canada's Anti-Spam Legislation (CASL) and the Personal Information Protection and Electronic Documents Act (PIPEDA) for clients in Canada, the Australian Privacy Act and Spam Act for clients in Australia, and applicable US state and federal law, including CAN-SPAM, for clients in the United States.

1. Who We Are

Ascension Living provides neuro-performance coaching, hypnotherapy-based programs, and Psychological Health and Safety advisory services. Our mailing address is 32 Captain James Crescent, Stratford, PEI C1B 4L6, Canada. For any privacy-related inquiry, contact us at [email protected].

2. Information We Collect

Personal Information. Your name, email address, phone number, mailing address, and any other information you voluntarily provide through booking forms, contact forms, subscription sign-ups, lead magnet downloads, or service inquiries.

Session and Intake Information. Information you provide during intake, discovery calls (Virtual Coffee, Hit The Wall), or coaching sessions, including health-related disclosures relevant to your participation in hypnotherapy or coaching, where you choose to share this.

Technical Information. IP address, browser type, operating system, referring URLs, and device information, collected automatically when you visit our website.

Usage Data. Pages viewed, links clicked, and time spent on our website.

Cookies and Tracking Technologies. We use cookies to operate our website, analyze traffic, and personalize content. Strictly necessary cookies are used to operate the site. Analytics and tracking cookies are only activated after you provide consent through our cookie banner. You can manage or withdraw cookie consent at any time through your browser settings or our cookie preference tool.

3. Legal Basis for Processing (GDPR/UK GDPR)

Where GDPR or UK GDPR applies, we process your personal data on the following bases: your consent (for marketing communications and non-essential cookies), the performance of a contract (to deliver a session, call, or program you've booked), our legitimate interests (to operate and improve our services), and compliance with a legal obligation, where applicable.

4. How We Use Your Information

We use the information we collect to: deliver and manage the services, sessions, and calls you've booked; respond to inquiries; send transactional communications related to your booking (confirmations, reminders, scheduling updates); send marketing communications, including content, updates, and offers, where you have given consent; improve our website and services; and meet legal, regulatory, or compliance requirements.

We do not use automated decision-making or profiling that produces legal or similarly significant effects on you.

5. Marketing and SMS Communications

We only send marketing emails and text messages to individuals who have provided express, opt-in consent through a clearly unticked checkbox at the point of booking or download. Marketing consent is always separate from, and never a condition of, booking a session, call, or downloading a resource.

You can withdraw consent at any time: reply STOP to any text message, click unsubscribe in any email, or contact us directly at [email protected]. We will process opt-out requests within 5 business days, and in most cases immediately.

Transactional messages related to a booking you've made (such as appointment reminders) may be sent even where marketing consent has not been given, as these are necessary to deliver the service you've requested.

6. Sharing Your Information

We do not sell or trade your personal information. We may share it only in the following circumstances:

Service Providers. We share information with trusted third-party providers who help us operate our business — including our booking platform, email and SMS communication tools, and payment processor. These providers are contractually required to protect your information and may only use it to provide services to us.

Legal Compliance. We may disclose information where required by law, court order, or legal process, or where we believe in good faith that disclosure is necessary to protect the safety of you or another person.

Business Transfers. If Ascension Living is involved in a merger, acquisition, or sale of business assets, your information may be transferred as part of that transaction, and you will be notified of any change in ownership or use of your personal data.

We do not transfer your personal data outside of the country in which it was collected except where our service providers require it to deliver their services (for example, cloud-based booking or email platforms), in which case we take reasonable steps to ensure appropriate safeguards are in place.

7. Data Retention

We retain personal information only as long as necessary to provide our services, comply with legal obligations, resolve disputes, and enforce our agreements. Consent records for marketing communications are retained for as long as you remain subscribed and for a reasonable period after unsubscribing to demonstrate compliance.

8. Data Security

We implement reasonable administrative, technical, and physical safeguards to protect your personal information. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

9. Your Rights

Depending on your location, you may have the right to: access the personal information we hold about you; request correction of inaccurate or incomplete information; request deletion of your personal information, subject to legal retention obligations; object to or restrict certain processing; withdraw consent at any time, without affecting the lawfulness of processing before withdrawal; and request a copy of your data in a portable format (GDPR/UK GDPR).

To exercise any of these rights, contact us at [email protected]. We will respond within the timeframe required by applicable law (generally 30 days under GDPR/PIPEDA).

If you are in the EU/EEA or UK and believe we have not addressed your concern appropriately, you have the right to lodge a complaint with your local data protection authority.

10. California Residents

If you are a California resident, you have the right to know what personal information we collect, request its deletion, and opt out of the sale or sharing of personal information. We do not sell your personal information. To exercise these rights, contact us at [email protected].

11. Children's Privacy

Our services are intended for adults aged 18 and over. We do not knowingly collect personal information from anyone under 18. If we become aware that we have inadvertently collected such information, we will delete it promptly.

12. Third-Party Links

Our website may contain links to third-party websites. These websites have their own privacy policies, and we are not responsible for their content or practices. We encourage you to review the privacy policies of any third-party site you visit.

13. Changes to This Policy

We may update this Privacy Policy from time to time. Changes will be posted on this page with a revised effective date. Where changes are material, we will take reasonable steps to notify you, such as by email or by posting a notice on our website.
